Verdict upheld against police in gun-planting

A federal appeals court upheld $3.7 million in damages Tuesday against the city of Oakland and two police officers who, according to a jury, planted an assault rifle on a parolee's property.

The officers, John Parkinson and Marcus Midyett, denied wrongdoing. Alex Katz, spokesman for City Attorney John Russo, called the verdict a "travesty" Tuesday and said that "the officers are the victims."

John Burris, a lawyer for Smith and Gray, said Oakland should have fired both officers.

(CBS) IRVINE, Calif. - An Orange County couple, both lawyers, knew exactly what they were doing when they planted drugs on the president of the school PTA, Irvine police say.

The couple face charges including one felony each of conspiracy to procure a false arrest, and conspiracy to falsely report a crime, Irvine police said.

NYPD Narcotics Detective Admits Cops Regularly Plant Drugs On Perps
A former NYPD Detective testified last week that he regularly saw police plant drugs on innocent people as a way to meet arrest quotas.

The corruption I observed... was something I was seeing a lot of, whether it was from supervisors or undercovers and even investigators," Anderson testified, according to the Post. Asked by Justice Gustin Reichbach how he felt about setting up innocent men, Anderson replied, "It's almost like you have no emotion with it, that they attach the bodies to it, they're going to be out of jail tomorrow anyway; nothing is going to happen to them anyway."

CIA unit's wacky idea: Depict Saddam as gay

During planning for the 2003 invasion of Iraq, the CIA's Iraq Operations Group kicked around a number of ideas for discrediting Saddam Hussein in the eyes of his people.

One was to create a video purporting to show the Iraqi dictator having sex with a teenage boy, according to two former CIA officials familiar with the project.

“It would look like it was taken by a hidden camera,” said one of the former officials. “Very grainy, like it was a secret videotaping of a sex session.”

The idea was to then “flood Iraq with the videos,” the former official said.


Another idea was to interrupt Iraqi television programming with a fake special news bulletin. An actor playing Hussein would announce that he was stepping down in favor of his (much-reviled) son Uday.

“I’m sure you will throw your support behind His Excellency Uday,” the fake Hussein would intone.

The spy agency’s Office of Technical Services
collaborated on the ideas, which also included inserting fake “crawls” -- messages at the bottom of the screen -- into Iraqi newscasts.

San Jose, Calif., man framed in rape by police, prosecutor to settle with city


In an attempt to get Kerkeles to confess, San Jose Police Sgt. Matthew Christian concocted a phony crime report that claimed Kerkeles’ semen was found on a blanket at the scene of the crime.

In fact, the actual report, which prosecutor Jamie Stringfield kept in a file in her office, showed no sign of Kerkeles’ semen.

While there was no other evidence that Kerkeles was involved in the sexual assault, Stringfield used the falsified report to persuade a judge that there was probable cause to charge Kerkeles.

Identifying Police Misconduct

Police Officer uses falsified evidence to incriminate citizen.

Timothy McMahon is the attorney who fought to get a settlement from the City of San Jose on behalf of Michael Kerkeles. In 2005 Mr. Kerkeles was falsely accused of rape of a mentally impaired female. The only piece of evidence against him was a report from the Santa Clara County Crime Lab by an analyst, Rebecca Roberts. The case unraveled when it was learned that there is no Rebecca Roberts in the lab. She was a totally fictitious person. In April, 2013 Mr. Kerkeles was awarded $150.000 by the City of San Jose.

Mr. McMahon is pleased that the City has acknowledged its error. He is also seeking an award for court expenses. There is another piece of unfinished business. The detective who perpetrated the false document has never been reprimanded by the police department. In fact, Michael Christian has been promoted. Is this how the SJPD should handle this behavior?

How Superiors throughout the justice system cover up the crimes of cops.  The City Attorney's Office concluded that the officer forgot he fabricated evidence to incriminate a citizen of a crime when he provided it to the District Attorney.

Christian, the officer, is now assigned to the Internal Affairs unit responsible for investigating public and internal complaints about cops -- which Kerkeles' attorneys claim is akin to the fox guarding the henhouse.

Undercover police informant busted planting drugs in legal smoke shop by in-store surveillance cameras

The owner of a smoke shop in New York busted an undercover police informant planting crack in his store thanks to multiple in-store surveillance cameras. Unfortunately, this is hardly an isolated incident. The New York City Police Department, for example, has fabricated numerous drug charges, according to a former narcotics detective, and one officer was even thrown in a psych ward for revealing systemic corruption in the department.

The practice can also be seen outside of New York.

Earlier this month, Columbia, South Carolina, a police captain stated in a sworn affidavit that he was approached by then-Deputy Police Chief Ruben Santiago about planting cocaine and a stolen gun in a city official’s car.

Also earlier this month, in England, a detective admitted that he was involved in a deal to plant a shotgun and drugs in someone’s car.

Clearly, this is a problem across jurisdictions.
