On March 15, 2008 Palo Alto Police Officer Kelly Burger fired his Taser gun at my face without warning while I was holding my hands in the air. This happened after I was unlawfully detained, for the officers stated I was violating a non-existent ordinance. Fortunately I blocked the Taser probes with my arm. One probe lodged into my arm and the other grazed my chin causing a small cut. Officer Burger proceeded to shock me even though I was not resisting or fleeing. Officer Burger shocked me for over twenty seconds. A second officer, Manuel Temores, also shocked me with his Taser gun. Four audio/video recordings, (two from the patrol cars and two from two Taser-CAMs), recorded the incident along with the two Taser gun Data Ports which document the duration of activations. All six recordings were edited, altered and falsified in order to cover up the officers' unlawful assault of me. I was initially charged with felony resisting arrest. I retained the services of a forensic expert, Gregg Stutchman of Napa, who verified that the Taser videos had been tampered with. As a result Santa Clara County DDA Javier Alcala decided not to show Judge Thang Barrett any of the falsified videos or technical data. Judge Barrett dismissed the charges against me citing that the officers violated my Constitutional Rights. I have filed a law suit,"Case 5:09-cv-02655," filed in United States District Court Northern District of California. Judge Koh has dismissed the 4th and 14th Amenment claims that I had filed against the PAPD. |
